The plaintiffs in a suit for eviction being Ejectment Suit No. 99 of 2014 pending before the 2nd Civil Judge (Junior Division), Alipore, District 24-Parganas (South) are the petitioners of the present revisional application under Article 227 of the Constitution of India.
The petitioners are complaining noncompliance of the order under Order XI Rule 12 of the Code of Civil Procedure.
Mrs. Chatterjee, learned advocate for the petitioners informs this Court that July 28, 2022 is the next date fixed in the suit for the compliance of the order of discovery.
C.O. 1692 of 2022 is disposed of by requesting the learned Trial Judge to pass necessary order in default of compliance of the said order of discovery on the next date fixed.
Petitioners are required to communicate this order to the opposite party as well as to her learned advocate in the Court below before the said next date of the suit.
The learned Trial Judge is further requested to expedite the disposal of the said suit.
There shall be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the party subject to compliance with all requisite formalities.
