Mr. Niladri Sekhar Ghosh Ms. Sompurna Chatterjee Ms. Labani Sikhder Mr. Souvik Dey ...for the petitioners Mr. Sardar Sahin Imam Ms. Suveni Banerjee ..for the State Considering the serious nature of allegations and the materials available in the case diary including the statement of the victim recorded before the learned Magistrate and the respective roles ascribed to each of the petitioners, while I am granting anticipatory bail to the petitioner nos. 1, 3 and 4, I am not inclined to grant anticipatory bail to the petitioner nos. 2 and 5. Accordingly, the application for anticipatory bail of the petitioner nos. 2 and 5 is rejected.

In the event of arrest, the petitioner nos. 1, 3 and 4 shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal

Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner nos. 1, 3 and 4 shall not threaten or intimidate witnesses and shall stay outside the jurisdiction of Goghat Police Station for a period of three months from this date, except for attending Court or meeting the Investigating Officer.

The application for anticipatory bail is, thus, disposed of. (Jay Sengupta, J.)
