Heard learned counsels for the parties.

The petitioner is unhappy with the investigation procedure and charge sheet being submitted without dealing with the allegation made out. The petitioner seeks re-investigation of the matter under the supervision of a superior authority.

It appears that though the charge sheet has been submitted upon completion of investigation the interest twenty seven victims who have been cheated/duped has not been investigated. Charge sheet appears to have been submitted hastily without holding proper investigation.

In view of the above, this Court is inclined to hold that the matter needs to be re-investigated in order to unearth the truth.

The matter be re-investigated under the supervision of the Additional Superintendent of Police, Bongaon Police District, North 24 Parganas. It is expected that the investigation will be conducted in a fair, unbiased and impartial manner upon consideration of every aspect of the allegation, in accordance with law.

With the above direction and observation the writ petition is disposed of.

Case Diary be returned.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
