252 of 2025 directed that the respondents and their men and agents be restrained from disturbing the peaceful possession of the petitioner. But, inspite of the same, the private respondents have been pursuing their illegal activities and interfering with the peaceful enjoyment of the property of the petitioner.

Learned advocate appearing for the State submits a report which reflects

that on information being received, General Diary Entry has been recorded.

The records of the case reflect that the petitioner has preferred an application under Section 163(2) of the BNSS. The records also speak that the dispute which has been referred to in the writ petition as well as the report submitted before this court resulted in registration of Deganga PS Case No. 339 of 2025. The said case was initiated at the behest of the present petitioner.

The police authorities are in knowhow of the issues as the civil court is in seisin of the matter and the investigation of the criminal case is already in progress.

So far as the establishment of the right is concerned, the petitioner would approach the learned civil court for necessary directions. However, as the criminal case has already been registered,

presumably, the petitioner and the private respondents are in a strained relationship, as such, the police authorities would ensure that no breach of the peace and/or tranquility takes place as also no untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations, WPA 12299 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the petitioner.
