The petitioner prays for expeditious disposal of Title Suit No. 239 of 2022, pending before the learned Civil Judge (Junior Division), Kakdwip. Records reveal that Misc. Case No. 17 of 2021 is pending since long and dates have been fixed for S.R. As this is an innocuous prayer, this court is of the view that no further notice is required to be served upon the opposite parties.

The learned court below is directed to dispose of the Misc. Case upon affording an opportunity to all the parties to contest the same. Such disposal shall be made within a period of two months from the next date fixed. Thereafter, on the basis of the order that shall be passed in the Misc case, parties shall be at liberty to pray for expeditious disposal of the suit. It is made clear that this court has neither gone into the merits of the Misc. Case nor into the merits of the suit. The learned court below shall

proceed independently, on the basis of the records and in accordance with law.

A copy of the revisional application along with a server copy of this order be served upon the opposite parities within a week.

The revisional application is accordingly disposed of.

There shall be no order as to costs.

Parties are to act on the server copy of this order.
