Kultali Police Station Case No.449 of 2023 dated 04.07.2023 under Sections 147/148/149/323/325/307 and other allied Sections has been started against the present petitioner for allegation that he has assaulted the police personnel during area domination by the police authority at the time of Panchayat Election. It appears that the present petitioner was also involved in other 17 (seventeen) offences of similar nature.

Learned counsel for the petitioner submits that this is a very old case and the present petitioner's appearance for the purpose of betterment of the investigation is not necessary. Charge-sheet has been submitted in this case. He prayed for anticipatory bail on any condition. 3.

Learned counsel appearing for the State raised strong objection and submits that the present petitioner was leading the mob to assault the police authority. Some of the police personnel were assaulted brutally at that time. Placed the C.D.

Having heard the learned counsel for the parties and considering the materials in the C.D. and also considering the nature of the offences alleged against the present petitioner, it appears to this Court that though there are some other cases wherein the present petitioner was

involved but in respect of the present case, which is a very old case started in the year 2023 and wherein the charge-sheet has already been submitted, further custodial interrogation of the present petitioner is not necessary.

Accordingly, under the above circumstance, the prayer for anticipatory bail of the petitioner is considered and allowed. 6.

Accordingly, It is directed that in the event of arrest, the petitioner be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only), with two registered sureties of like amount each, subject to the satisfaction of the learned ACJM, Baruipur, South 24 Parganas on condition that the petitioner must appear before the Investigating Officer once in a week until further order and shall also comply with the provisions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Return the C.D. immediately.
