Learned advocate appearing for the petitioner submits that, all the four accused were named in the statement recorded under Section 164 of the Code of Criminal Procedure (Cr. P. C.), three were granted bail. Out of three persons granted bail, two were granted bail by the Coordinate Bench and one by the Jurisdictional Court.

Learned advocate appearing for the State draws the attention of the Court to the statement recorded under Section 164 Cr. P. C.

The statement recorded under Section 164 Cr. P. C. names four persons. Out of such four persons, three were granted bail.

Considering the fact that the police concluded investigation and submitted charge-sheet, we grant bail to the petitioner.

Accordingly, we direct that the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Malda, subject to the condition that the petitioner shall appear before the trial court on every date of hearing until further orders and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever.
