At the time of call petitioner is represented by learned advocate who has submitted that the sole petitioner has died. It is also submitted by the learned advocate representing the petitioner that she has not received any instruction for filing any application for setting aside abatement of writ proceeding and substitution of heirs of the deceased sole petitioner.

In view of aforesaid submission the writ petition stands dismissed since the writ proceeding stands abated.

However, there shall be no order as to costs.

After passing this order Mr. Jha, learned advocate representing the petitioner (deceased) submits that petitioner's wife is alive and the matter relates to stoppage of pension.

In view of such submission leave is granted to the wife of the petitioner to take steps in

accordance with law, if so advised.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
