Mr. Lal Mohan Basu .....for the State Ms. Oindrila Sinha, Mr. Koushik Chatterjee Mr. Nilanjan Adhikari ...for Respondent Nos.3 to 6 06-01-2025 AKG Ct. 15 The petitioner raises the grievance that, although he retired from service as a Group-C staff member of Contai Municipality on January 31, 2022, the Municipality has yet to release his pension.

The Municipality has filed a report, the relevant portion of which is quoted below:

"6. That on 31st January, 2022 the petitioner was retired from service.

7. That the total amount of sanctioned gratuity has already been released to the petitioner.

That the Photostat copy of the gratuity statement is annexed herewith and marked as Annexure - "R-1".

8. That the municipal authorities send the pension file to the Director of Pension, Provident Funds, Gratuity and Group Insurance, Government of West Bengal on 07th February, 2022 and now the petitioner getting provisional pension but inspite of receiving the pension file of the petitioner till date no reply was received by the municipal

authorities till date."

In light of the above report, there appears to be no justification for keeping this writ petition pending. I direct the Director of Pension, Provident Funds, Gratuity, and Group Insurance, Government of West Bengal, to take necessary steps to release the petitioner's pension, along with any arrears, within four months from the date of this order.

Accordingly, WPA 13337 of 2024 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
