The petitioner is the defendant No.1 in Title Suit No.138 of 2023. The petitioner prays for expeditious disposal of the application for temporary injunction pending before the learned Civil Judge (Junior Division), 1st Court at Barasat, North 24-Parganas.

The petitioner submits that all pleadings are complete and the defendants have filed their written statement and written objection.

As this is a case of expeditious disposal of the application for temporary injunction, this Court does not find it necessary to direct issuance of notice upon the opposite parties. All the parties stand to gain if a litigation progresses on an urgent basis.

Thus, considering the contentions of the petitioner, the revisional application is disposed of with a direction upon the learned Civil Judge (Junior Division), 1st Court at Barasat,

North 24-Parganas, to dispose of the application for temporary injunction within three months from the next date fixed. This Court has neither gone into the merits of the application for temporary injunction nor into the merits of the suit. The learned court below shall hear out the application upon affording adequate opportunity to all the parties to make their respective submissions.

A copy of the revisional application along with a server copy of this order be served upon the opposite parties within course of this week.

The revisional application is disposed of.

There will be, however, no order as to costs. Parties are to act on the basis of the server copy of this order.
