Learned advocate appearing for the petitioner is aggrieved by the fact that the petitioner could not enter her residence as she was resisted and was apprehensive regarding her insecurity as she intended to participate as a candidate in the panchayat election.
Mr.
Mondal, learned Additional Government Pleader appears on behalf of the State and submits a fresh report. The report reflects that there are cases and counter cases being Joypur Police Station case no. 221/2023 which is against the petitioner and also Joypur Police Station case no. 222/2023 which was initiated at the behest of the petitioner. In both the cases chargesheets have been submitted. Having considered the nature of the offences for which the cases have been registered both by the
petitioner and against the petitioner, I am of the view that the same arose out of local trivial issues and the police authorities would be able to handle the situation, in case the same is blown out of proportion.
Accordingly, if the petitioner is apprehensive that she may be faced with inconveniences if she enters her residence, I direct that the petitioner along with her daughter would report to the Officer-in-Charge of Joypur Police Station, who would ensure that in case the petitioner resides at her home no inconveniences are caused to her. The concerned Officer-in-Charge will depute a police personnel who would every alternate day visit the petitioner and take a report as to whether she has been subjected to any threat, coercion or inconveniences or any sort of incident which may blown out of proportion in future, as also relating to her insecurity. Such a report in writing would be recorded as a General Diary Entry on each and every occasion when such police personnel visits the residence of the petitioner. Such arrangement would continue for the next 30 days and it would be the discretion of the Officer-inCharge to ensure that the insecurity felt by the petitioner be diluted within the aforesaid period of 30 days. With the aforesaid observations WPA 13338 of 2024 is disposed of.
Report so submitted by the State be kept with the record.
A copy of the report be handed over to the learned advocate appearing for the petitioner.
