1. Although, the petitioner had filed the instant writ petition complaining unauthorized and illegal construction made by the respondent no. 8 and had sought for a direction upon the municipality to initiate proceeding under Sections 217 and 218 of the West Bengal Municipal Act, 1993, however, today the learned advocate appearing for the petitioner would submit that the petitioner does not wish to proceed with the instant writ petition. Written instruction in this regard as placed before this Court is retained with the record.

2. The municipality is not represented.

3. According the writ petition is dismissed as withdrawn with a cost of Rs.5000/- to be paid by the petitioner to the West Bengal State Legal Services Authority.
