05.06.2023 sdas rejected C.R.M.(DB) No. 2069 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Ashoknagar Police Station Case No. 1149 of 2022 dated 14.12.2022 under Sections 328/376 of the Indian Penal Code.

And In Re : Saukat Mal .... petitioner Mr. Arnab Chatterjee ....for the petitioner Mr. Joydeep Roy Mr. Amanul Islam .... for the State Learned Counsel for the petitioner submits allegation of rape is out and out false. Family members of the victim were present there.

Learned Counsel for the State opposes the bail prayer. We have considered the materials on record including the statement of the victim. Petitioner claimed to be a mendicant i.e. tantrik. From the statement of the victim it appears he administered medicine to the victim. She became semiconscious and was ravished. In view of the aforesaid materials on record and the nature of offence, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.
