Mr. Soumyajit Das Mahapatra Ms. Madhurai Sinha ...for the petitioner Mr. Arijit Ganguly Mr. Samarjit Balial ..for the State It is submitted by the petitioner that the name of principal accused is Mr. Raju Mahata, son of Ranjit Mahata and the name of the petitioner has been falsely implicated and he is in no way connected with the instant case. More so, he is in custody for 161 days. Charge sheet has been submitted. There was no T.I. parade and the offending weapon has been recovered from the place of occurrence.

Learned prosecution raises strong objection.

Having heard the learned advocates for the parties and going through the materials on record and the contents of the FIR coupled with by the statement made under Section 164 Cr.PC by the defacto complainant after a lapse of few days and the statement given by the other witnesses under Section 161 Cr. PC, prima facie, I find sufficient incriminating materials exists against the present

petitioner, hence this Court is not inclined to allow the prayer of the petitioner. Hence Rejected.

Accordingly, the C.J.M. Paschim Medinipur, is directed to expedite the process of commitment considering the period of detention of the accused persons.

Accordingly, the application for bail is disposed of. (Chaitali Chatterjee (Das), J.)
