No. 29 CHC Rejected C.R.M.(A) 1671 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Farakka Police Station Case No. 25/2024 dated 01.02.2024 under Sections 341/324/325/326/307/34 of the Indian Penal Code and Sections 25(1)(a)/27 of the Arms Act.

And In the matter of : Bikash Ghosh ...... petitioner Mr. Tapodip Gupta ....for the petitioner Mrs. Amita Gaur, Mr. Subham Kanti Bkakat ....for the State Petitioner stands implicated in the incident of assault resulting in multiple fractures. Petitioner also caused fracture on the neck of the fibula of the victim.

Victim recorded her statement under Section 161 of the Criminal Procedure Code where she speaks of the petitioner using firearm.

Considering the gravity of the offence and the involvement of the petitioner as transpiring from the materials in the Case Diary, we are unable to grant anticipatory bail to the petitioner. This application for anticipatory bail is, thus, rejected. CRM(A) 1671 of 2024 is disposed of.
