In both the communication as well as the statement, the opposite party no. 2 has expressed that she do not intend to continue with the proceedings arising out of Karaya Police Station Case No. 299 dated 01.08.20220 under Section 498A/406/34 of the Indian Penal Code, and also wishes to withdraw the same.

Having considered that the dispute and differences between the parties arose out of matrimonial discord and that mutual divorce has already taken place on 6th May, 2024, I direct that since there has been change of circumstances, further continuance of the proceeding, being Karaya Police Station Case No. 299 dated 01.08.2020, as also the charge-sheet submitted before the learned Chief Judicial Magistrate, Alipore under Section 498A of the Indian Penal Code would result in harassment and hardship to the present petitioner. Considering the aforesaid, further proceedings of Karaya Police Station Case No. 299 dated 01.08.2020, including the charge-sheet so submitted before the learned Chief Judicial Magistrate, Alipore, be as such quashed.

Consequently, CRR 1948 of 2024 is allowed.

Connected application, if any, is consequently disposed of.
