Affidavit-of-service filed on behalf of the petitioner is taken on record.

Learned advocate representing the petitioner submits that brother of the petitioner went missing on 13th May, 2026 as a result whereof a missing diary was lodged on 14th May, 2026 before the concerned police authority of Chakdaha Police Station.

Subsequently, on 17th May, 2026 petitioner submitted a written complaint based on which FIR was drawn up and criminal prosecution was initiated being Chakdaha Police Station Case No.710/2026 dated 17th May, 2026 under Section 140(3) of BNS.

However, it is contended on behalf of the petitioner that necessary steps are required to be taken to trace out brother of the petitioner.

Learned advocate representing the State respondents has filed a communication dated 16th June, 2026 of Inspector-in-Charge, Chakdaha Police Station and same is taken on record. Copy of the communication

dated 16th June, 2026 is made over to the learned advocate representing the petitioner.

It is disclosed in the communication dated 16th June, 2026 that steps are taken by the concerned police authorities to trace out brother of the petitioner. However, fact remains as on date brother of the petitioner is not traced out.

Concerned police authorities are directed to take steps on urgent basis to find out brother of the petitioner. 8.

Concerned police authorities are also directed to take the prosecution to its logical conclusion.

Writ petition stands disposed of.

10. However, this order shall not preclude the petitioner to take steps in accordance with law in future, if situation so arises.

11. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.)
