Despite service of notice, none appears for the petitioner. The learned advocate for the petitioner is present. The learned advocate for the petitioner further submits that the petitioner is out of station for treatment of his minor child. Accordingly, his personal appearance is dispensed with.

The report submitted by the learned Judicial Magistrate, 2nd Court, Siliguri, Darjeeling stated that the C.R. Case No. 102 of 2004 under Section 138 of the N.I. Act was dismissed for non prosecution on 17.12.2018. Let the said report be kept on record. Under such circumstances, the instant criminal revisional application has become infructuous and disposed of. Copy of the order be sent to the department and learned trial court for information.
