The present revisional application was preferred challenging the proceedings arising out of Complaint Case No.30052 of 2011 under Sections 420, 406 and 120B of the Indian Penal Code then pending before the learned Metropolitan Magistrate, 14th Court, Calcutta.
Records of the revisional application reflect that the interim order was granted till 5th November, 2014 and more than 61⁄2 years no information has been furnished regarding the present stage of the proceedings.
I have perused the subject-matter of complaint raised in the revisional application. I am of the view that the complainant should be allowed to adduce his (their evidence) before charge in connection with the instant case. The petitioners before this Court will be at liberty to agitate the points after the complainant has been able to adduce his complete evidence before the learned court below.
Accordingly, CRR 1804 of 2012 is dismissed.
Pending application, if any, is consequently disposed of.
Interim order, if any, is hereby vacated.
