Mr. Koushik Roy ..for the petitioners Mr. Siva Prasad Ghose Ms. Srijani Mukherjee ..for the opposite parties This application under Article of the Constitution of India is at the instance of the judgement debtor and is directed against an order dated 3rd May, 2025 passed by the learned Civil Judge (Junior Division), Bidhannagar, North 24 Parganas in Misc. Case No. 47 of 2023 arising out of Ejectment Execution Case No. 11 of 2022.

By the order impugned the application under Rule 208 of the Civil Rules and Orders stood allowed. When this matter was taken up for hearing on 12th June, 2025, the hearing of the civil revisional application was adjourned to enable the petitioners to move the second appeal which was pending.

The learned advocate appearing for the petitioners submits that in the meantime the second appeal stood dismissed by a judgement and order dated June 24, 2025. In view thereof, this Court is not inclined to interfere with the order impugned.

Accordingly, C.O. 1947 of 2025 stands dismissed.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
