Rakib (Rejected) CRM (NDPS) 1231 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Gazole Police Station case no. 170 of 2026 dated 24.02.2026 under Sections 21(c)/25/29 of the NDPS Act.

Till date the investigation reveals that 25 bottles of phensedyl being recovered from the present petitioner and charge-sheet has not yet been submitted.

As such, I direct the learned trial Court that in case there are no further recoveries in the present case, learned trial Court/Special Court will release the petitioner on bail after the charge-sheet is submitted before the jurisdictional Court on such terms and conditions as he deems fit and proper.

With the aforesaid observations CRM (NDPS) 1231 of 2026 is disposed of.

Memo of evidence submitted by the State be kept with the record.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
