1. This revisional application has been preferred challenging the judgment dated 26.03.2015 passed by the learned Additional Sessions Judge, 6th Court, Alipore, South 24 Parganas in connection with Criminal Appeal No. 173 of 2013, whereby learned Judge affirmed the judgment and order of conviction passed by learned Judicial Magistrate, 3rd Court, Alipore in connection with C-4238 of 2007 under Section 138 of the Negotiable Instrument Act.

2. Ms. Joyita Ray, learned counsel appearing on behalf of the petitioner/convict has filed one information slip showing payment of Rs.25,000/- in connection with C4238 of 2007, on 22.09.2015 and another payment receipt of Rs.25,000/- in connection with Case C-4238 of 2007 under Section 138 of the Negotiable Instrument Act.

3. Learned counsel appearing on behalf of the private opposite party No.2 has also submitted that the convict/petitioner has deposited the entire fine amount

imposed by the learned Judicial Magistrate, 3rd Court, Alipore in connection with Case No. C-4238 of 2007.

4. That being the position, the revisional application stands disposed of with a direction that the petitioner be discharged from the bail bond and also be set at liberty at once.

5. With the aforesaid observation, the revisional application along with connected application stand disposed of.

6. Liberty is given to the private opposite party No.2 to withdraw the amount deposited by the petitioner.

7. Photocopy of the deposited slip be kept with the record. (Bibhas Ranjan De, J.)
