The only prayer of the petitioner is that a direction be made on the respondent no. 4 being the Sub-Divisional Officer/Executive Magistrate, Diamond Harbour, South 24-Parganas to complete the proceedings pending before the respondent no. 4 being the Assistant Engineer, P.W.D, Joynagar Sub-Division, within a specified period of time. The complaint made by the petitioner on 13th June, 2022 to the respondent no. 5 indicates that unauthorized encroachment have come up on the petitioner's land preventing ingress and egress of the petitioner.

After hearing learned counsel including that of the State, WPA 11696 of 2022 is disposed of with a direction on the respondent no. 4 being the SubDivisional Officer/Executive Magistrate, Diamond Harbour, South 24-Parganas, to dispose of the pending proceedings under the provisions of the West Bengal Highways Act, 1964, as expeditiously as possible and preferably within a period of five weeks from date.
