Rakib (Rejected) CRM (NDPS) 1233 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliganj Police Station case no. 636 of 2025 dated 29.07.2025 under Sections 21(c)/29 of the NDPS Act.

Mr. Koustav Lal Mukherjee ......for the State.

Learned advocate appearing for the petitioner submits that petitioner is in custody for more than ten months; charge-sheet has already been submitted; charges have been framed and petitioner along with others have been implicated for alleged recovered 510 gram of heroin.

Learned advocate appearing for the State opposes the prayer for bail.

I have also taken into account the chemical examiner's report which do not enure any benefit to the present petitioner at this stage. Having considered the stage of the case, I am not inclined to release the petitioner on bail. As such, prayer for bail of the petitioner is rejected.

Petitioner will renew his prayer for bail after the evidence of seizure list witnesses are over.

Learned trial Court would within a period of three months from the communication of this order try to complete the evidence of the seizure list witnesses.

Thus, CRM (NDPS) 1233 of 2026 is dismissed.

Memo of evidence submitted by the State be kept with the record.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
