In the matter of : An application under Section 482 of the Code of Criminal Procedure.
The present revisional application has been preferred against the order dated 31st January, 2013 passed by the learned Additional Sessions Judge, Arambagh, Hooghly in connection with Criminal Revision No. 4 of 2012 wherein the subject matter of challenge was the order dated 12th March, 2012 passed by the learned Additional Chief Judicial Magistrate, Arambagh, Hooghly in Criminal Miscellaneous Case No. 53 of 2004.
I have considered the order passed by the learned Additional Chief Judicial Magistrate, Arambagh, Hooghly which was passed on 12th March, 2012 directing the husband to pay a sum of Rs.1000/- per month to the wife and Rs.1000/- per month to the minor daughter.
The learned Sessions Court while exercising its revisional jurisdiction has categorically fixed the dates so far as the arrear maintenance is to be paid.
Having regard to the quantum which has been fixed by the learned revisional court as also the learned Magistrate, I am of the view that no interference is called for by this court. Accordingly, the present revisional application being CRR 1211 of 2013 is dismissed.
However, having regard to the quantum and grievance of the present petitioners and the time which has elapsed, I direct the learned Magistrate to reconsider the quantum of maintenance if such an application is taken out by invoking the appropriate provisions of law. All pending applications, if any, are consequently disposed of.
Interim order, if any, is hereby vacated.
