Learned advocate appearing for the petitioner submits that the alleged recovery in this case is 43 kgs of ganja. Petitioner is in custody for more than one year four months and till date only one witness has been examined by the learned trial Court. Learned advocate appearing for the State opposes the prayer for bail.
Having considered the quantum of seizure in the present case, I am not inclined to release the petitioner on bail as rigors of Section 37 of the NDPS Act is attracted.
However, substantial time has passed since the petitioner is behind the bar, as such the learned trial directed to give priority to the evidence of the seizure list witnesses and complete their evidence within a period of 90 days from the date of communication of this order.
At this stage, CRM (NDPS) 1234 of 2026 is dismissed. Petitioner would renew his prayer for bail after the aforesaid time period is over.
Memo of evidence submitted by the State be kept with the record.
