Heard learned Counsel appearing on behalf of the parties.

Without going into the entire merits of the case made out by the petitioner, this Court is of the view that the petitioner should be allowed to seek fresh permission under Rule 239 of the West Bengal Excise (Foreign Liquor) Rules, 1989 within a period of four weeks from date.

The authorities are directed to consider the viability of fresh/renewal permission under the said Rule to the petitioner. The authorities shall act in accordance with law and ask for a police report and thereafter pass a reasoned order within a period of six weeks from making of application by the petitioner. The

reasoned order is to be communicated to the petitioner within one week from the date of passing of the same. With the above observations, this writ petition is disposed of.
