Case No.2611 of dated 17.12.2016 under Sections 120B/366A/370/370A of the Indian Penal Code and Sections 7, 9 of the Immoral Traffic (Prevention) Act and Section 17 of the POCSO Act.

Heard the learned Advocates appearing for the parties. Petitioner is in custody for more than five years. He submits there is slow progress in the matter. Learned Advocate for the State opposes the prayer for bail. He submits report with regard to the status of trial. We have considered the materials on record. Minor victims P.Ws.1, 2, 3, 4, 7 and 8 disclose prostitution was carried on in the residence of the petitioner. She played active role in the offence. In view of gravity of the offence involving trafficking of minors for sexual exploitation and the prima facie involvement of the petitioner therein, we are not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.

However, in view of protracted period of detention suffered by the petitioner, we request the trial court to conclude the trial as expeditiously as possible preferably within six months from the next date fixed for recording evidence without granting unnecessary adjournment to either of the parties.
