Learned counsel for the petitioner contends that despite having applied for a new electricity connection, the petitioner has not been able to get such connection from the CESC Limited.
Learned counsel appearing for the CESC Limited submits, by placing reliance on the affidavit-in-opposition of the CESC Limited and its annexures, that the CESC Limited has raised a dispute as regards apprehended splitting of load if a new connection is given to the petitioner.
Since the concerned Grievance Redressal Officer (GRO) is the appropriate authority competent to decide such issues of fact, it will not be proper for the writ court to interfere at this juncture.
Accordingly, WPA 11719 of 2022 is disposed of by granting liberty to the petitioner to approach the concerned GRO with the dispute as raised herein.
If so approached, the GRO shall, upon giving opportunity of hearing to all concerned, decide the issues in accordance with law as expeditiously as possible, preferably within six weeks from the date of such reference being made to the GRO.
Affidavit-in-reply filed in court today be kept on record.
