Learned advocate representing the CESC Limited submits, upon instruction that, there has been no request for granting new electricity connection, neither has there been any additional load supplied in the subject premises.

Learned advocate representing the Corporation submits, upon instruction that, the property in question was inspected on 17th October, 2023 when it was revealed that the structure at 70A, Block-D, New Alipore

Kolkiata-700 050 is an old existing building but the some construction works including addition, alteration and structural modifications have been made in the ground floor (back side) without permission from the Corporation.

The Department has issued stop work notice with intimation to the New Alipore station.

It was detected that defying the stop work notice, construction was going on and, accordingly, round the clock police posting was sought for.

At the time of inspection, no construction work was detected. The construction work is lying suspended. From the report filed by the Corporation, it appears that unauthorised constructions have been detected.

The Executive Engineer (Civil)/Building/Borough X is directed to take necessary steps to deal with the unauthorised construction in accordance with law after giving reasonable opportunity of hearing to all the necessary parties. Steps shall be taken at the earliest but positively within a period of twelve weeks from the date of communication of this order.

Copy of the instructions forwarded by the engineers of the Corporation signed on 17th October, 2023 be retained with the records.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
