Report submitted by Mr. Suman De, learned advocate appearing for the State be kept with the record. Report encloses a statement of the opposite party no.2 wherein she contends that she do not intend to pursue with the Baruipur Women P. S. Case No. 9 of 2022 dated 27-01-2022 under Sections 498A/406/34 of the Indian Penal Code. It has also been submitted before this court that mutual divorce has taken place between the parties. Having regard to the fact that the dispute and differences arose out of matrimonial discord and the lady is not interested to pursue the criminal case, I am of the view that further continuance of the proceedings are unwarranted in the facts and circumstances of the instant case.

Accordingly, all further proceedings including the chargesheet submitted in connection with Baruipur Women P. S. Case No. 9 of 2022 dated 27-01-2022 which is pending before the

learned Additional Chief Judicial Magistrate, Baruipur is hereby quashed.

Consequently, the revisional application being CRR 1894 of 2023 is allowed.

Pending applications, if any, are disposed of accordingly. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
