Mr. Susmita Dey (Basu), learned counsel appears for the petitioner.

Mr. N.C. Bihani, learned senior counsel with Mr. Soumyajit Ghosh, learned counsel appears for the CSTC. The father of the petitioner was an employee of respondent no. 1. After demise of the father the petitioner being the son had received the compassionate appointment. The father throughout his employment tenure used this name as Nagendranath Biswas. At the time of appointment of the petitioner, the petitioner also received the compassionate appointment in place and instead of his father the said Nagendranth Biswas. All the relevant service records of the father stood at all material time showing his name as Nagendranath Biswas.

Susmita Dey (Basu), learned counsel appearing for the petitioner submits that subsequently

the petitioner discovered that the name of the father was Gouranga Biswas. According to her the said name Gouranga Biswas had also appeared in various service records. The claim of the petitioner was lodged for change of name when by the impugned order dated October 9, 2004 annexure p-10 at page 28 to the writ petition the employer has rejected the same.

Nayan Chand Bihani, learned Senior Advocate appearing for the respondent nos. 1 to 4 submits that during the employment tenure all along the father of the petitioner maintained his name as Nagendranath Biswas. The relevant service records, pension document everything stood as such. Even at the time of receiving compassionate appointment the petitioner accepted the said name as Nagendranath Biswas.

Mr. Bihani, submits that there is no merit in this writ petition and the reasoned order of rejection dated October 9, 2024 is just and proper.

After considering the rival contentions of the parties and upon perusal of the materials on record, this court is of the view that, the reasons shown in the impugned order have no infirmity and the same is in sync with the service record of the deceased father of the petitioner who maintained his name as Nagendranath Biswas during his life time. The petitioner also accepted

his compassionate appointment in place and instead of Nagendranath Biswas being his father.

In view of the forgoing reasons and discussions this court shall not interfere with the said reason order dated October 9, 2024 and shall not go for any further enquiry into all these question of facts.

Accordingly, this writ petition WPA 12430 of 2025 stands dismissed without any order as to costs. (Aniruddha Roy, J.)
