Petitioner is aggrieved by the fact that in spite of informing the Officer-in-Charge of Kalyani Police Station no steps have been taken and the petitioner has suffered loss to the tune of Rs.96 lakhs because of the deception of one Subhrakanti Nag.

Learned advocate appearing for the State has submitted a report. Report reflects that a written complaint of Subhasis Kundu was received on 26.04.2025 at Kalyani Police Station and it has been reflected in the report that on the selfsame allegations two specific criminal cases have already been registered being Kalyani P.S. Case no. 716/23 and Kalyani PS Case no. 1080/2024. Both the cases have been transferred to the Directorate of Economic Offence Wing and further investigation along with appropriate legal action are being taken in connection with the said case.

Having considered that the Inspector-in-Charge of Kalyani Police Station has dealt with the subject matter and referred to two criminal cases which one already being investigated by a specialized wing of the State police, I am of the view that until and unless a different case is made out further registration of FIR is not required. However, it is reflected from the report also on 17.06.2025 a hard copy of the complaint was dispatched to the Director of Economic Offence Wing by Kalyani Police Station which has been duly received. In case there are separate facts relating to the sufferance of the present petitioner the specialized agency will not deter for registering a fresh case.

With the aforesaid observations WPA 12201 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
