Kar Medical College (2021-2022 batch).

It has been candidly submitted by the learned advocate appearing for the petitioner that the petitioner could not clear his first year examination even in his third attempt. It has further been submitted by the learned advocate for the petitioner that on earlier

occasions, the students were allowed to clear the examination by one additional "mercy attempt". The petitioner made a representation dated April 8, 2024 before the Controller of Examination, West Bengal University of Health Sciences for granting him one additional attempt to clear his first year examination The said prayer has not yet been considered.

Learned advocate appearing for the petitioner submits that the petitioner's representation should be considered by the Controller of Examination, West Bengal University of Health Sciences.

In view of that matter, I dispose of this writ petition with a direction upon the Controller of Examination, West Bengal University of Health Sciences to consider the representation dated April 8, 2024 appearing at page 20 of the writ petition in accordance with law within a period of two weeks from the date of communication of this order.

Accordingly, WPA 13395 of 2024 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
