Learned advocate appearing for the petitioner submits that petitioner is in custody for eight months, charge-sheet has been submitted but till date charges has not been framed. Learned advocate appearing for the State on the other hand submits that two other accused persons were evading the process of law, as such there has been no progress in the case. The present case involves alleged recovery of 1355 grams of heroin. It has been informed that the other two accused persons have been granted anticipatory bail.
As such, learned trial Court would at the earliest overcome the stage of consideration of charges and thereafter give priority to the evidence of the seizure list witnesses to be examined preferably
within a period of three months from the date of charges being considered.
At this stage, the prayer for bail of the petitioner in CRM (NDPS) 1242 of 2026 is rejected.
Petitioner will renew his prayer for bail after the aforesaid time period is over.
Memo of evidence submitted by the State be kept with the record.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
