Bhattacharya .....for the respondent no. 4 to 7 Mr. Sandipan Banerjee Mr. Ankit Surekar .....for the Howrah Municipal Corporation The present writ application has been preferred praying for direction upon the Howrah Municipal Corporation to dispose of the petition and objection dated 10.01.2018 filed in the mutation case in respect of holding no. 186, Girish Ghosh Road and has further prayed for quashing of order dated 01.02.2018. It appears from the said order that the commissioner Howrah Municipal Corporation vide the said order had heard the matter as per direction of the Hon'ble High Court dated 09.11.2017 and passed a well reasoned order.
It is the case of the petitioner that an objection has been filed by the petitioner in respect of the said order but it has not been disposed of till date. Considering the said materials on record, it appears that at this stage, the objection filed by the
writ petitioner dated 10.01.2018 is pending with the HMC.
Accordingly, the respondent Howrah Municipal Corporation is directed to dispose of the said objection in accordance with law within a period of 60 days from the date of communication of this order. In case a copy of the said objection is not available with the Corporation, the petitioner is granted liberty to file a copy of the same within 7 days from the date of this order and the authority concerned shall dispose of the objection in accordance with law as directed.
Writ application stands disposed of.
Applications, if any, connected thereto stand disposed of consequently.
Interim order, if any, stands vacated.
Let a copy of this order be sent to the Trial Court at once.
Photostat certified copy of this order, if applied for, being given to the parties on priority basis upon compliance of all formalities.
