Due to circumstance beyond his control he could not appear before the trial court and his bail was cancelled in 2019. He surrendered before the trial court in 2023 and was taken into custody. He prays for bail.
Learned lawyer for the State opposes the bail prayer. He submits petitioner has criminal antecedents. He had absconded for three years. Trial is in progress.
We have considered the materials on record. Petitioner was enlarged on bail in 2016. Thereafter he absconded in 2019 and surrendered before the trial court in 2023.
In view of the aforesaid conduct of the petitioner and gravity of the offence we are not inclined to grant bail to the petitioner. Accordingly, prayer for bail is rejected.
