The applicant has prayed for recalling the order passed by this Court on August 10, 2022 on the ground that though it has been recorded that the order under contempt has been substantially complied with, the alleged contemnor has not complied with the order in its entirety since the certificate case has not been disposed of in terms of the direction given by this Court.

By the order passed on 10th August, 2022, this Court disposed of the contempt application with an observation that the order under contempt has been substantially

complied with. Today the alleged contemnor produces copy of a letter issued to the Officer-in-charge of the Hare Street Police Station, Kolkata - 700012 on 1st March, 2024 directing the latter to arrest the certificate debtors unless they pay the sum of Rs.78,813/- due to the applicant.

Accordingly, this Court is inclined to hold that the alleged contemnor has substantially complied with the order under contempt and there is no reason for recalling the order passed on 10th August, 2022.

In view of the above, the application being CAN 1 of 2022 is dismissed.

There shall however, be no order as to costs.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
