Mr. Amajit De, Special PP .... For the CBI. The Special Leave Petition is filed assailing the judgment & order passed by learned Additional Session Judge, Fast Track Court No.2, Purulia in connection with Sessions Case No. 43 of 2001 wherein charge-sheet was submitted by the C.B.I. against Ashok Kumar Roy and Ajoy Kumar Sen under Section 323/330/348/465/471/306/201 and 120B of the Indian Penal Code.

After trial accused Ashok Kumar Roy was found guilty of committing offence punishable under Sections 330/306 of Indian Penal Code and sentenced to suffer imprisonment accordingly. But accused Ajoy Kumar Sen was found not guilty of committing any offence charged against him. C.B.I. has filed this Special Leave Petition to file an appeal against the order of acquittal of both the accused namely Ashok Kumar Roy and Ajoy Kumar Sen from the charge under Section 348/465/471/201 and 120B of the Indian Penal Code. After careful perusal of the judgment I find no reason to disallow the Special Leave Petition. Thus, leave is granted to file appeal within the statutory period.

Accordingly Special Leave Petition stands disposed of.
