Party Allowed C.R.M. (A) 1852 of 2025 In Re : An Application for bail under Section 438 of the Code of Criminal Procedure read with Section 482 of the Bharatiya Nagarik Suraksha Sanhita, in connection with Kaliachak Police Station Case No. 1174 of 2021 dated 24.10.2024.

And In Re :

(1) Samrul Sekh @ Samrul

(2) Tahir Sekh @ Tahir Sk.

(3) Sambul Sekh @ Md. Saimul Sk @ Sammur ... Petitioners Md. Wasim Akram Ms. Sabrina Parveen ... for the Petitioners Mrs. Anasuya Sinha Mrs. Afreen Begum ... for the State Mr. Deepak Prahladka Mrs. Reshmi Khatun ...for the defacto complainant Heard learned counsels for the parties.

Learned counsel for the petitioners submits that the co-accused have been granted anticipatory bail by the learned Sessions Judge. Charge sheet has been submitted. The petitioners pray for anticipatory bail.

Learned counsels for the State opposes the prayer. I have considered the material on record. About forty live bombs were recovered from the house of the 3rd petitioner. Some other bombs exploded in his house. Considering the material on record and alleged involvement

of the 3rd petitioner in the offence, prayer for anticipatory bail of the 3rd petitioner is rejected.

However, considering the extent of complicity of the petitioner nos. 1 and 2 in the alleged incident, their prayer for anticipatory bail is allowed.

Accordingly, in the event of arrest the petitioners (1) Samrul Sekh @ Samrul and (2) Tahir Sekh @ Tahir Sk. be released on bail on furnishing bond of Rs.10,000/-(Rupees Ten Thousand only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and subject to provision under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioners shall appear before the jurisdictional Court and pray for regular bail within two weeks from date.

The application for anticipatory bail is, thus, disposed of.

Case Diary be returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
