Versus
The State of West Bengal and another Mr. Arun Kumar Maiti (Mohanti) Mr. R.R. Mohanty Ms. Komal Shaw Mr. Samit Shaw Ms. S. Ghosh Mr. S. Saha.
...for the petitioners.
Md. Anwar Hossain Ms. Manisha Sharma.
...for the State.
The revisional application has been preferred challenging Jagacha P.S. Case No.368 of 2022 dated 01.12.2022 under Sections 341/326/307/506/34 of the Indian Penal Code. The enclosures to the revisional application only contain the formal FIR and certain medical documents.
Mr. Anwar Hossain, learned advocate, who ordinarily appears on behalf of the State, is directed to represent the State. His appearance may be regularised by the concerned authorities. Having regard to the nature of contentions advanced in the revisional application and the cognizable offence which are reflected as contents of the letter of complaint which has been treated to be the First Information Report, I am of the view that at the stage of continuation of investigation, there is no scope for
interference.
Accordingly, CRR 1902 of 2023 is dismissed.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
