Learned counsel for the petitioner submits that charge sheet was submitted on May 31, 2015. Evidence of PW-1 was concluded on February 19, 2019 and thereafter there has been no further development in the matter.

It appears from the order of the learned Trial Court dated April 03, 2024 that the learned Legal Remembrancer was requested to appoint learned Special Public Prosecutor in the case. The State is not able to apprise the Court whether the learned Special Public Prosecutor has been appointed till date. In view of the above, this Court is inclined to hold that the learned Legal Remembrancer be requested to appoint learned Special Public Prosecutor in the matter at the earliest. Upon

appointment of such learned Special Public Prosecutor, the learned Trial Judge is directed to conclude the trial of the case within one year from the date of appointment of the learned Special Public Prosecutor without granting any unnecessary adjournment to either of the parties, in accordance with law. CRR No. 1977 of 2024 is disposed of accordingly. A copy of this order be communicated to the learned Legal Remembrancer, Government of West Bengal at the earliest. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
