Petitioner apprehends that he may be thrown out of the property and his property may be grabbed at the behest of the private respondents.

State has submitted a report. Report reflects that the police authorities conducted an enquiry and in fact also called the adjacent owner. So far as the report of the police is concerned it reflects that the petitioner was not found at the said premises at the time of enquiry. However, the police authorities have assessed that the construction which was going on was pursuant to a sanction plan being issued by the Kolkata Municipal Corporation.

Police report reflects that the boundary wall which has been referred to was in respect of the owner of the

said property namely, Suvash Chowdhury who is associated with an adjacent plot of land.

Be that as it may, the petitioner claims to be in possession of the property. The report also do not dispute that the petitioner has an association with the property. Having considered that the petitioner apprehends that the private respondents may grab the property and throw him out, I direct that the police authorities would oversee that no untoward incidents resulting because of the property dispute existed between the petitioner and the private respondents.

With the aforesaid observations WPA 12188 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
