Ms. Jhuma Sen Ms. Sikha Halder Mr. Swastika Chatterjee ...for the Petitioner In this application, the petitioner has prayed for a direction upon the court below for expeditious disposal of M. case no. 461 of 2023 filed under Section 125 of the Code of Criminal Procedure along with interim maintenance application under Section 125(3) of the Code, presently pending before the Learned Judicial Magistrate, 10th Court, Alipore.

Being aggrieved by the inordinate delay in disposal of the prayer for maintenance, learned counsel for the petitioner submits that her client filed the above-mentioned Misc. case seeking maintenance along with a prayer for interim maintenance on 29th May, 2023 and since then, the interim maintenance application is pending for disposal and the opposite party/former husband is taking time one after another on various pretext.

Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite parties will have no cause to prejudice

and as such, the service of copy of application upon the opposite parties is hereby dispensed with.

Considering the fact that the interim maintenance application of the petitioner is pending for about three years, I find that the prayer made by the petitioner is justified and required to be allowed for the ends of justice. In view of above, the instant application being CRR 2462 of 2025 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the interim maintenance application of the petitioner dated 29.5.2023 preferably within a period of one month from the next date of hearing.

Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
