Petitioner Mr. Jisan Iqubal Hossain ...for the petitioner Mr. Somnath Bera ...for the State Memo of evidence filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the mother in law of the alleged victim. The marriage between the couple in question took place about 13 years ago. The husband was arrested and was thereafter granted bail. Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He refers to the statements of witnesses including those of neighbours and the 11 year old daughter of the victim lady. According to one of the neighbors, the husband of the victim was having an illicit affair with another woman and wanted to get rid of the victim.

The petitioner also could not stand the alleged victim. On the fateful day, i.e., 19th September, 2025, in the evening, the husband started a quarrel and thereafter both the husband and the present petitioner held the victim by her hair and mercilessly assaulted her with fists, blows and kicks. After some time, the victim set herself from fire by pouring kerosene oil.

father used to assault the victim on a regular basis. On the particular day, she saw the father slapping her mother. Soon thereafter, the victim committed suicide.

Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
