Service report filed by the State is taken on record. Learned Advocate for the petitioner submits that out of family dispute the petitioner has been falsely implicated in this case. The petitioner is in custody for 128 days. He seeks for enlargement of the petitioner on bail.

Opposing such prayer for bail, learned Advocate for the State submits that the victim clearly implicates this petitioner in her statement before the Magistrate which has also been stated by her before the attending doctor. She seeks for dismissal of the bail application.

Learned Advocate for the de facto complainant submits that the victim at the time of incident was minor aged about 7 years. The victim clearly implicates the petitioner. He also seeks for dismissal of the bail application.

Perused the case diary and the materials on record. The victim at the time of incident was 7 years of age. It is found from the statement of the victim that she implicates the petitioner of his involvement in sexual assault. Considering the above materials and nature and gravity of the offence, I am not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected. The application for bail being CRM (M) 817 of 2025 stands dismissed.
