Learned counsel for the petitioner submits that opposite party/husband has filed Matrimonial Suit No.160 of 2023 at Krishnagar, Nadia which actually does not have the territorial jurisdiction in terms of Section 19 of the Hindu Marriage Act. 2.

Learned counsel for the opposite party/husband has fairly submitted that the Matrimonial Suit No.160 of 2023 may be transferred from the court of learned District Judge, Krishnagar, Nadia to the court of competent jurisdiction under learned District Judge at Suri, Birbhum.

In view of the submissions, Matrimonial Suit No.160 of 2023 is transferred from the court of learned District Judge, Krishnagar, Nadia to the

learned District Judge at Suri, Birbhum for trial in accordance with the law.

During the course of submissions, learned counsel for the opposite party/husband has submitted that the opposite party/husband is suffering from heart ailment. Learned trial court is requested to not to insist the personal appearance of the opposite party/husband and opposite party may appear through video conferencing before the learned trial court.

The transferee court is directed to send the record to the transferor court.

The petition stands disposed of.
