The petitioners have challenged the continuance of Maheshtala Police Station Case No. 6 of 2024 under Sections 498A/406 of the Indian Penal Code which is pending before learned Additional Chief Judicial Magistrate, Alipore. I have taken into account the allegations made in the letter of complaint which was instituted on 04.01.2024. The letter of complaint reflects that marriage was solemnized on 20.02.2022 and registered on 11.12.2022.

Having regard to the close proximity of time within which disputes and differences arose and the allegation of physical and mental torture being inflicted for further demand of dowry at this stage without the investigation being taken to its logical conclusion, I am not inclined to interfere with the investigation which is continuing.

The petitioners are granted liberty to take up all the issues after the investigating agency arrives at a logical conclusion by way of submitting its report under Section 173 of the Code of Criminal Procedure.

With the aforesaid observations, the revisional application being CRR 1964 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
