Father of the petitioner, since deceased, was a licensee of a fair price shop. He expired on 15th June, 2013. As the father of the petitioner was ill before his death, licence of fair price shop was renewed in the year 2013. Subsequently, in the year 2014 the son of the deceased licensee being the petitioner herein made an application praying for granting licence in favour of him as he satisfies all the

requisite conditions for grant of licence. The said application was not disposed. Subsequently, he made another representation followed by a demand justice. Finally he filed the instant writ petition. During pendency of the writ petition the District Controller, Food & Supplies, Purba Burdwan, respondent No.5 herein sent a letter to the learned advocate for the petitioner that the letter demanding justice addressed by Sri Timir Baran Saha, learned advocate, High Court, Calcutta dated 2nd May, 2023 was forwarded to the Sub-Divisional Controller, Food & Supplies, Burdwan (Sadar) for consideration. The learned advocate appearing on behalf of the respondents does not refute the contention made by the learned advocate for the petitioner. Under such circumstances, the instant writ petition is disposed of directing the Sub-Divisional Controller, Food & Supplies, Burdwan, respondent No.6 herein to dispose of the notice demanding justice dated 2nd May, 2023 after giving opportunity of hearing to the petitioner within a period of 45 days from the date of communication of this order.

The instant writ petition is, thus, disposed of. (Bibek Chaudhuri, J.)
