Petitioner is aggrieved by the fact that the private respondent no.4 happens to be the son and private respondent no.5 happens to be the daughterin-law who are trying to grab the property and in order to attain their illegal objective, they are assaulting both the petitioners and by one way or the other trying to end their life. To that effect by a communication dated 09.03.2024 petitioners informed Dakshineswar Police Station wherein it was alleged that the private respondent regularly assaulted the parents and lastly they made a desperate attempt to murder them with poisonous gas while they were sleeping at night, however, the petitioners saved themselves by coming out of the room.

Report of the police authorities reflect that a long standing dispute has been going on between the petitioners and the private respondents. To that effect earlier also petitioners had approached this Court and this Court by an order dated 03.01.2024 in WPA 24093 of 2023 disposed of the writ petition with certain directions. Since on 09.03.2024 information was communicated with the concerned police station and there was an earlier direction upon the Officer-incharge to act promptly, I direct that the Officer-incharge should have dealt with the information furnished on 09.03.2024.

Report submitted by the State reflects that the proceedings under Section 107 of the Code of Criminal Procedure has been drawn up on or about 9th May, 2024. Be that as it may since the petitioners are senior citizens, I direct that a lady constable be deputed who every alternate day for a period of four weeks will visit the residence and ascertain as to whether there has been any physical torture being inflicted at the behest of the private respondents upon the petitioners. Within the aforesaid four weeks petitioner would approach the police authorities under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The concerned authority if it passes any directions, then the police authorities

would respect, obey and implement the said directions.

With the aforesaid observations WPA 13515 of 2024 is disposed of.
